The Legal Architecture of Impunity

U.S. v. Cruikshank (1876) — Supreme Court threw out Colfax massacre convictions. Ruled federal government couldn't prosecute private violence. Every massacre from 1876 to 1964 happened in the legal space this ruling created.

Easter Sunday. Black men defending a courthouse. Supreme Court ruling gutted federal prosecution power afterward.

Striking Black sugarcane workers massacred by planters and militia. Bodies dumped in fields.

The only successful coup d'état in U.S. history. Elected government overthrown. 2,000+ expelled.

Four-day mob attack on Black neighborhoods. Businesses burned and looted.

6,000 displaced. Police aided the mob. W.E.B. Du Bois led 10,000-person silent march in protest.

537 injured. 1,000 Black families left homeless. 25+ cities struck that same summer.

Black sharecroppers organizing a union. U.S. Army troops participated. 67 Black survivors charged.

Election Day. Black residents tried to vote. Entire community expelled. No prosecutions.

Tulsa (Greenwood), OK
Est. killed: 300+
35 blocks burned. 10,000 homeless. National Guard arrested Black survivors. Last survivor died 2023.

Est. killed: Unknown
Town burned to the ground. Community permanently destroyed. Partial compensation: $150K/survivor in 1994.

All 80 Black residents expelled under Ohio's 'Black Laws.'
1894Monett, MO
300 Black residents expelled after a lynching.
1901Pierce City, MO
300 expelled after 3 Black men lynched. Homes and businesses seized.
1903Joplin, MO
Entire Black population driven out. No property returned.
1905/1909Harrison, AR
Two separate expulsions. Documented sundown town into 21st century.
1912Forsyth County, GA
1,000+ expelled from entire county. Land seized. Kept out for generations.
1920Ocoee, FL
Election Day massacre and expulsion. No Black residents for decades.
The Full Restitution Record

In 1994 — 71 years after the Rosewood massacre — Florida paid $150,000 to each of nine living survivors. That is the complete national record of financial restitution for racial massacre. One incident. Nine people. 160 years of documented destruction.
